C (A child) [2013] EWCA Civ 431 (25 April 2013)

The CA dismissed the appeal of a natural father against an order refusing him to defend adoption proceedings and be joined as a party to these. In the unusual circumstances of the case the father had not seen or had any contact with the child as he had thought he was the child of another man. However the child was now four and had been living with prospective adopters for two years and was settled and happy there. The CA also commented on the delay in obtaining a transcript of the judgment and gave firm guidance as to the conduct of future appeals in respect of placement orders including the need for these to be placed before a Lord Justice as soon as the appellant’s notice is received without waiting for the transcript.
